Vin et Passion Inc . (Vinetpassion.com) exploits the Web Site http://www.vinetpassion.com/ (le "Site"). The use of the Web Site is governed by sales conditions appearing below, a contract between Vin et Passion and the user. These conditions may be modified at all times by Vin et Passion.

1. HOW TO USE THE SITE
1.1 Viewing the site
Vinetpassion.com is located in Canada. Vinetpassion.com makes no representation to the effect that the elements on the site cannot be used elsewhere than Canada and should not be accessed to where legislation prescribes that the use or contents is illegal. For those who choose to use this site it is of their own initiative and must abide to the local bylaws. All claims pertaining to the elements and contents of this site are regulated by laws applicable in the province of Quebec.

The contents of the site and its elements are supplied as is, without any guarantees, implicit or explicit without prejudice of public order or to the contrary.Many products sold by Vinetpassion.com come with a limited warranty provided by the product manufacturer. As much as Vinetpassion.com does all that is possible for the site to be error free. Vinetpassion.com shall have no liability to any person or entity with respect to any liability, loss or damage, including actual, indirect, special incidental or consequential damage, cause directly or indirectly by the use or performance of any product sold by Vinetpassion.com.
2. GENERAL SALES CONDITIONS
Placing an order
Receiving a confirmation of an order by email is not an automatic sale confirmation. Vinetpassion.comreserves the right without prior notice to refuse to do business with whomever or limit the quantity of an order. It could be necessary for Vinetpassion.com to verify personal credit information before accepting all order.
2.1 Terms of Payment
2.1.1 We accept Visa. MasterCard, and American Express
2.1.2 We do not accept checks, or money-orders
2.2 Prices
2.2.1 The price you pay is the price appearing on the website.
2.2.2 Taxes and delivery are extra.
2.2.3 Vinetpassion.com reserves the right at all times to change prices offered on the Web.site.
2.2.4 All prices are listed in Canadian Funds
2.2.5 The prices on the Web.Site could differ from the prices at VinetPassion Inc.
2.3 Return of Merchandise
- For the policy on returning decanters ,glassware, and all crystal items (see article 2.3.6)
- For policy on returning software, books, Wine tasting and aroma kits and gift certificates (see article 2.3.7)
- For policy on returning wine cabinets or cellar conditioner (see article 2.3.8)
2.3.1 You can return all products at Vinetpassion.com within 15 days of receipt of goods at : VinetPassion.com 1910, Ave. Pierre Péladeau Ave. LAVAL, Québec, H7T 2Z6. Sales slip and order number must be included. No questions askes, no penalty.
2.3.2 To return products for reason other than being defective, you must assume delivery charges and the risk involved in returning the products. You cannot return a product if it is not in its original package.
2.3.3 For a defective product, it will be replaced for the same product. If Vinetpassion.com delivered the wrong product, it will then return the Wright one assuming risk and charges providing our customer service was notified and the carrier informed to return it to us.(The term defective also applies for missing or erroneous parts)
2.3.4 Upon receipt of returned merchandise, we will credit you as soon as possible for the returned merchandise excluding delivery charges providing the merchandise returned is in the same condition it was when received at destination.
2.3.5 It is also possible to return merchandise ordered on the Web. To Vin & Passion.Inc. Retail stores. All conditions mentioned above apply. Under no circumstances will the freight charges be reimbursed by Vin & Passion retail store exploited by VinetPassin.Inc.
2.3.6. Policies for glasses, carafes, glassware and crystal
2.3.6.1 There will be no refunds or exchange for glassware,decanters,or crystal.
2.3.6.2 Products defective upon receipt: Upon receipt of the merchandise by PUROLATOR, you must verify that there is no damage. If the merchandise is damaged at delivery, you must make a claim within 48 hrs at PUROLATOR giving them your claim number at 1 888 SHIP-123 or 1 888 744 7123. PUROLATOR will then pick-up and return it to us.
2.3.6.3. Vinetpassion.com assumes freight charges and risks providing you have contacted our customer service department and the shipper's agreement to be returned to us. The returned articles should include, invoice, and order number. Before merchandise is shipped . Vinetpassion.com carefully inspects to make certain the merchandise is not damaged and defective free.
2.3.7 Policies for returning software, books, scented games and gift certificate
2.3.7.1 There is no refunds or exchange for software, books, scented games or gift certificates.
2.3.7.2 If the software you purchased is defective or has a technical problem, we will verify the reason, you will receive technical support or on line link.
2.3.8.Policies for returning wine cabinets cellar conditioner
2.3.8.1 No refunds or exchange on wine cabinets and cellar conditioners.
2.3.8.2 Pruducts defective upon receipt: Upon receipt of the Purolator delivery, you must verify that there is no damage. If so, you must make a claim within 48 hrs with Purolator giving them your claim number at 1 888 SHIP-123 or 1888 744 7123. Purolator will pick-up and return it to us. If the box is damaged, refuse delivery.
2.3.8.4 Defective products at trial. The manufacturer offers a variability guarantee. All details are included with the merchandise.
2.3.8.6 Wine cabinets and cellar conditioner purchased at VinetPassion.com cannot be exchanged or refunded in stores.
2.4.Availability of products
The Web site posts all products that can be ordered at the supplier. Be advised that they may not be available at Vinetpassion.com's inventory or on the Web site. In this case your order will be delayed. Should you be in a hurry to receive one or more of the articles you ordered, place a separate order for the said articles.
2.4.1 Vinetpassion.com does not guarantee the availability of products offered on the web site. Should Vinetpassion.com not be able to deliver an ordered article, Vinetpassion.com will notify you by e-mail and you will have these options.
2.4.1.1. Maintaining an active order on the web and authorizing the site to ship the product(s) without notice upon receipt from the supplier. Payment will be taken from your credit card before delivery by the carrier chosen by you when placing the order. At all times before delivery, for items out of stock, you can cancel your order by contacting customer service on the web site. Be advised, that out of stock items will be ordered within days of receipt of your web order.
2.4.1.2 No payments will be taken from your credit card when cancelling on line.
2.4.2 Be advised that orders placed with our supplier for out of stock items will automatically be cancelled after 90 days.
2.4.3 VinetPassion.com will not be responsible for damages that you may have occurred for out of stock items.
2.5 Delivery
2.5.1 Vinetpassion.com will deliver your order at the address given when placing the order.
2.5.2 Freight charges correspond to the number of articles ordered. See our freight chart to know the charges of your order.
2.5.3 Vinetpassion.com will deliver your order as soon as possible. Delays and freight charges may vary depending on the location, choice of carrier and products availability. Delivery is estimated from the moment it leaves Vinetpassion.com.
2.5.4 From the time the product ordered at Vinetpassion.com reaches the carrier, you are the owner and are held responsible of it's lost or destruction.
2.5.5 You are responsible for all fees when we are shipping outside of Canada. All duty and export fees will be of your responsibility.
2.5.6 Deliveries are subject to the rules Vinetpassion.com encounters with it's carriers, Purolator, Canada Post and others from time to time. You are liable for the signature upon delivery of products. If you are absent from the address given to Vinetpassion.com it will be your responsibility to retrieve the products according to the rules of the carrier chosen when placing the order.
2.5.7 There are no deliveries at Post Office Box Numbers
2.5.8 Payment must be received in full at Vinetpassion.com before delivery is made.
2.6 Responsability
2.6.1In the event Vinetpassion.com is responsible, only the equivalent of what you paid will be refunded to you.
2.6.2 In spite of the above articles nothing in this article can limit the wrights that you may have as a consumer to access the public laws that may be applicable to you.
2.7.Major force
Vinetpassion.com will not be held responsible in part or in whole of obligations, damages or lost you may occur if the unfulfilled, the damages or the lost occurred is from a major circumstance that is beyond our control.
